Paulaner Fan Dream - Football vs. Basketball.

1. Event promoter, eligibility

Paulaner Brauerei Gruppe GmbH & Co. KGaA, Ohlmüllerstr. 42, 81541 Munich (hereafter referred to as "Organizer") is the organizer of the contest and thus exclusively responsible for its implementation.

1.1. Eligible to participate in the contest regarding the Paulaner Fan Dream “Football vs. Basketball” (hereafter referred to as “Football vs. Basketball”) are all persons that are at least 18 years of age at the beginning of the application period on April 13th, 2017. Employees of the Paulaner Brewery Group and any of their affiliated are excluded from participating on „Football vs. Basketball“.

1.2. End of the application period of the contest in the course of the online application (see clause number 4) is September 10th, 2017. Supplement on 10 September 2017 by the organizer:
The registration deadline will be extended until 15 October 2017, 12.00am - until then the participants have time to upload or edit their contributions..

1.3. Eligible to participate are only participants that acknowledges the participation rules , particularly the determinations of the rights of use (clause number 9), the sending of e-mails (clause number 12) and the choice of the German law  (clause number 15) during the application. This occurs through activating a button with the content “I read the conditions of participation and agree to them.” on the website www.paulaner-fantraeume.de.

1.4. The participation also assumes that the participant will provide the organizer with certain personal details and permit the organizer to process and use these details for the purposes of executing the contest. This occurs through activating a separate button with the content “I read the data protection notice and agree to the collection, processing and use of my data.” on the website www.paulaner-fantraeume.de. 2. Costs

2.1. For the participation on “Football vs. Basketball” no participation fee is imposed.

2.2. The organizer will bear the costs of accommodation and catering of the chosen participants of “Football vs. Basketball”, but not the arising expenses for the journey to Munich.

 

3. Multi-stage Contest

3.1. The contest is multi-staged. First, suitable candidates will be chosen from all participants for an intensive evaluation through a jury appointed by the organizer. The jury then checks the results of the questionnaire of the candidates, inspects the uploaded online contributions and forms an opinion of the chosen candidates through research and, if necessary, through personal inspection.

3.2. At the end of the selection period the jury will nominate the participants from the chosen candidates at its own discretion. These participants will compete with the players of FC Bayern München football or respectively with FC Bayern München Basketball against the representatives of FC Bayern München and its fans of the other sport in „Football vs. Basketball“. The organizer reserves its right to give away further spots in the team via wildcard at its own descretion. Furthermore, the organizer reserves its right to give the oppotunity to participants from the chosen candidate circle to directly receive a spot in the team through competitions, special tasks or similar.

 

4. Online application

4.1. The online application occurs through registration on the website of the organizer www.paulaner-fantraeume.de (hereafter referred to as “the website”).

4.2. Each participant may only register once for every team. Multiple registrations for one team are not permitted. The participant may only conduct his own application. An application through a third party or for a third party is not permitted.

4.3. The participant can enter his data online into an application form accessible on the website. The application can only be executed if the fields that are marked as mandatory are filled out. The entry of further data is voluntary. Type errors can be corrected in the application form. The registration process can be stopped at any time; in this case the entered data will be deleted.

4.4. The participant is obliged to enter his real name and age and to give truthful particulars to his or her state of health. The participants can upload a photo of themselves; however voluntarily.

4.5.The participant is responsible for the accuracy and currency of the details entered. Any changes of the entered data must be updated in due time.

4.6. The organizer is authorized to reject applications without giving reasons. In this case, the entered data will be erased.

4.7. After the successful registration the participant will receive an e-mail with a link for the confirmation of the registration – and to his or her private area. Here the participant has the possibility to add a profile picture to his application. Afterwards questions regarding the person, as well as the topics sport, Bavaria and Paulaner will be asked and have to be answered by the participant. In addition, the participant has the opportunity to voluntarily fulfill the chosen online tasks for his selected team (football or basketball).

4.8. The participant receives a username (his e-mail address) and chooses his own password for his account. The participant is able to correct, change or delete the entered data anytime through accessing his account.

 

5. Handout of wildcards

The organizer reserves its right to give away additional positions for the participance on „Football vs. Basketball“ via wildcard (direct access) at its own discretion.

 

6. "Football vs. Basketball" with the players of FC Bayern München football and FC Bayern Basketball

6.1. The finale of “Football vs. Basketball” presumably takes place in fall 2017. Thereby, pros of FC Bayern München Football and the most suitable candidates that applied for “Team Football” compete against pros of FC Bayern Basketball and the most suitable candidates that applied for “Team Basketball”. Here the teams compete in “football-isch”, “basketball-isch” and Bavarian disciplines against each other. This competition presumably takes place in Munich. The organizer will choose the player combination from the circle of the nominated participants at its own discretion. The nomination of a participant through the jury does not constitute any legal claim of participation as a player of “Football vs. Basketball”.

6.2. The exact event-data (time, place, etc.) will be timely communicated to the nominated participants through e-mail or in written form.

 

7. General rules

7.1. The organizer reserves the right to change the structure of the competition at any time, even at short notice, at its own discretion.

7.2. The organizer reserves the right, upon provision of reasons, to change the rules of participation at any time, or to postpone or cancel the competition at any time and without liability to the participants.

7.3. By submitting their application, each participant confirms his fundamental willingness to participate on “Football vs. Basketball“ in case of his selection.

7.4. The organizer has the right to verify the identity and eligibility of a participant at any time. Participants who fail to produce the necessary supporting evidence within a reasonable time period may be excluded from the competition.

7.5. All personal information and the information that is required by and entrusted to the organizer must be true and complete and must not be misleading in any way. The organizer may exclude any participant from the competition who provides false, incomplete or misleading personal information, and in particular false information about his state of health or physical condition.

7.6. The organizer may replace participants who are unable to enter the contest or have been excluded from it (for example due to illness, incapacity or a breach of the rules) with other participants, even if they were not previously selected or were excluded from the contest.

7.7. The decisions of the organizer or the jury are final and binding and cannot be challenged even if no reasons are given for them. The mere act of registering does not entitle applicants to participate in and contribute to the competition.

7.8. The participants hereby agree to act in a reasonable manner at all times during the competition, in particular in a fair and sporting manner, and to comply with the rules of entry as well as all other rules which apply at the competition's venue. The organizer may exclude participants from the venue or competition if they fail to obey these rules or if they act in an inappropriate manner.

 

8. Use of participant profiles and contributions

After successfully completing the online application, participants have the option to upload supporting contributions in the form of text, photos and videos. The participants hereby agree that the organizer may select these contributions at its discretion and post them on the website and Facebook page of the Paulaner Fan Dreams.

 

9. Participant and user contributions

9.1. The participant and/or user undertakes not to upload or place any contributions or content on the website that break current law or breach these entry rules.

9.2. In particular, the participant and/or user agrees not to insert any contributions or contents or refer to any telemedia

 

  • which constitute hate crimes
  • which have insulting or defamatory content
  • which contain pornographic or other content which breaches juvenile protection laws
  • which illegally use content or symbols that are protected in particular by copyright, trademark, name, patent, design patent or utility patent laws
  • which contain images or sound recordings of third parties without their consent
  • which contain images or sound recordings of persons under the age of 18, or which include direct or indirect publicity for products, services, political parties or ideologies
  • which breach the precept of sporting fairness

9.3. The participant shall not use any malicious software or insert any links to other telemedia.

9.4. The organizer will not appropriate any content which has been added by the participants. The organizer shall be entitled at all times to exclude contents from publication or delete any content that breaches the provisions set out above and to exclude the relevant participant from the contest.

 

10. Assignment of rights

10.1. The participant hereby agrees to the creation of audio and video recordings without remuneration as part of the “Football vs. Basketball”competition, as well as preparatory, follow-up and/or accompanying reporting, particularly by the organizer's media partners. At the same time, the participant hereby grants the organizer and its partners and media partners the exclusive use, free of charge, of all of the participant's rights of use, performance, privacy or other rights (e.g. merchandising, additional printing rights, online/internet rights), including the right to his own image and the protection of his name and all user rights thereto, and including the right of reproduction, the right of public access, the right of distribution, the right of making available on demand, the right of communication to the public and the adaptation rights, without limitation in terms of space, time and content, for all types of use arising or resulting from the produced sound and/or visual recordings and any resulting television, radio or other production, as well as to the text, image and sound content uploaded by the participant to the organizer's website, regardless of its content and purpose. The organizer is entitled to partially or entirely transfer or sublicense these rights.

10.2. The participant hereby guarantees that he has not assigned, and will not assign, the rights being granted under this agreement to any third parties and that the granting of these rights does not violate the rights and claims of any third parties. The participant hereby indemnifies the organizer and its partners and media partners from all claims by third parties.

 

11. Liability

11.1. The organizer's liability and that of its agents and officers for culpable damages including consequential damages will be excluded as long as the damage was not caused by malice or gross negligence. This will not apply to death, physical injury or harm to the health or the culpable breach of major contract duties. In the event of a culpable breach of major contract duties which are due to circumstances other than malice or gross negligence, the organizer's liability will be limited to typically foreseeable damage.

11.2. The organizer will not be liable for personal injury to the participant caused by other participants, or which result from the participant's health problems.

 

12. Data protection and privacy

12.1. The organizer may collect, process and use the participants' personal information for the purpose of carrying out the “Football vs. Basketball” competition. Detailed information about this is described in the privacy notices for participants, which require the participants to consent to the use of their personal information.

12.2. Information about the use of cookies to store IP addresses and the use of Google Analytics on the website www.paulaner-fantraeume.de is contained in the general privacy policy.

 

13. Acceptance of the rules of entry; non-compliance

13.1. By entering the competition, the participants accept these rules of entry.

13.2. Non-compliance with the rules of entry will result in the respective participant's disqualification from the competition.

 

14. Exclusion of legal proceedings

Legal recourse is excluded within the context of this competition.



15. Applicable law

The organization of the competition, the legal relationship between the organizer and the participant, the legal relationship between the organizer and the website visitors, as well as these terms of entry and their creation, are subject exclusively to German law with the exclusion of all legal standards which refer to another legal system.

 

16. English language version

The English language version of these rules of entry serves only as a reading aid for non-German-speaking participants. Only the version of the rules of entry in the German language is legally binding.
